1. General informational purposes

The information provided by us on the Site and in marketing materials about our mobile application is for general informational and promotional purposes only. All information on the Site is provided in good faith; however, we make no representation or warranty of any kind, express or implied, regarding the accuracy, adequacy, validity, reliability, availability, or completeness of any information on the Site.

UNDER NO CIRCUMSTANCE SHALL WE HAVE ANY LIABILITY TO YOU FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SITE OR RELIANCE ON ANY INFORMATION PROVIDED ON THE SITE. Your use of the Site and your reliance on any information on the Site is solely at your own risk.

We may update, change, or remove Site content at any time without notice. Pricing, plans, discounts, and offers shown on the Site are illustrative unless confirmed at checkout in the app or on a purchase page. We reserve the right to correct errors, inaccuracies, or omissions on the Site at any time.

Everdance is not a medical organization. Content on the Site about dance, fitness, mental wellness, or lifestyle is not medical advice, diagnosis, or treatment. Nothing on the Site should be construed as a recommendation to begin or change any exercise program without consulting a qualified healthcare professional.

Dance and home workouts involve physical exertion and risk of injury. Before following any choreography or classes in our app, you should seek advice from a physician or other qualified provider, especially if you have health conditions, are pregnant, or are recovering from injury. 3. User content and hosting

The Site may display or link to user-generated videos, reviews, testimonials, or community content. We act as a hosting intermediary and do not pre-screen all such material. We do not endorse, guarantee, or assume responsibility for user content. Liability for user content rests with the person who posted it, to the fullest extent permitted by law, including under Section 230 of the Communications Decency Act (United States) and Article 14 of the E-Commerce Directive (European Union), as described in our Terms of Use.

Your use of the Site does not create a doctor-patient, therapist-client, trainer-client, fiduciary, or other professional relationship between you and Everdance or any instructor featured on the Site or in the app. Instructors and contributors are independent for purposes of content they provide unless we expressly state otherwise.

7. Limitation of liability (summary)

To the fullest extent permitted by applicable law, Everdance Inc. and its directors, employees, agents, and affiliates disclaim liability for damages arising from your use of or inability to use the Site, including indirect, incidental, special, consequential, or punitive damages.

For use of the app and paid services, liability limits and exclusions are set out in Sections 13–14 of our Terms of Use (including the cap of the lesser of amounts paid by you to us or USD $100, where applicable). Some jurisdictions do not allow certain exclusions; in those cases, our limitations apply only to the maximum extent permitted by law.

8. Age and eligibility

The Site is directed at a general audience. Use of the app is subject to minimum age requirements (13+ in the United States, 16+ in the EEA, UK, and Switzerland, and other limits as stated in our Terms of Use and Privacy Policy). Parents and guardians are responsible for minors who access the Services.

9. Language

Any translation of this Website Disclaimer is for convenience only. If there is a difference in meaning between a translation and the English version, the English version prevails.
